Kaczmarek v. Organized Crime Agency of BC, 2022 BCHRT 63

Naz Mitha QC and Erin White successfully represented the respondent employer before the BC Human Rights Tribunal with respect to a late-filed human rights complaint. 

The complainant had worked for the respondent in an office position. During her employment she requested various accommodations. She filed a human rights complaint on May 18, 2021, alleging the accommodations provided in October and November 2019 were not sufficient, and that in January 2020 she had not been provided with a permanent position. The complaint was filed outside the one-year statutory time limit.

The respondent employer argued that the complaint should not be accepted for filing as it was not in the public interest to do so. The Tribunal agreed, and declined to accept the late-filed complaint for filing.
