Squamish (District) v. CUPE Local 2269 (Shard Grievance), [2020] B.C.C.A.A.A. No. 21 (Appeal Denied, 2020 BCLRB 95)

Successful in having the suspension of a union president for bullying and harassment upheld. The employer had suspended the union president for bullying and harassment. The union argued that the suspension was unlawful and that as union president, the employee was entitled to act more aggressively. The arbitrator disagreed with the union and upheld the employer’s suspension noting that union executives are not shielded from bullying and harassment because of their position in the union. The union appealed the decision to the Labour Relations Board, and we successfully argued that the appeal should be dismissed. The Labour Board agreed.
